1.DELIVERY OF GOODS BY A THIRD PARTY CARRIER
All goods delivered on behalf of clydewindows.com by any third party carrier are insured against damage during door-to-door transit/delivery. The receiver of the goods should carefully inspect all packaging for signs of damage or apparent damage upon receipt of goods, or sign unchecked if this is not a viable option at the time of delivery. If the packaging is in anyway whatsoever, torn, crushed, missing in part or whole, or the goods themselves are damaged in anyway whatsoever, or missing in part or whole, then the third party Carrier's delivery note should not be signed as 'RECEIVED IN GOOD CONDITION'. If the receiver of the goods is unsure or suspect about the goods having been damaged, then the third party Carrier's delivery note should not be signed! Instead, the receiver should clearly write on the delivery note 'GOODS RECEIVED DAMAGED' and include all details of the damage (including carton numbers, item descriptions and a description of the damage/missing parts).

UNDER NO CIRCUMSTANCES SHOULD THE RECEIVER ACCEPT ANY DAMAGED GOODS AND SIGN FOR THEM AS PER NORMAL DELIVERY. FAILURE TO INSPECT DELIVERED GOODS UPON ARRIVAL WILL INVALIDATE ANY CLAIM AGAINST THE CARRIER AND A CLAIM FOR COMPENSATION!

2. GENERAL TERMS & CONDITIONS OF SALE
The terms & conditions set out below apply without variation to every sale entered into by the company hereinafter referred to as the 'Company' for the sale of Goods, materials and services unless the variations thereto are expressly agreed to, in writing by the Company.

Acceptance: All orders accepted by the Company will be subject to these Conditions of Sale. If the Buyer issues his own Purchase Order containing Conditions of Purchase these Conditions of Sale shall be deemed to be incorporated in such Purchase Order and shall override any conflicting provision of the Purchase Order.

Pricing: All prices quoted on this web site or otherwise are valid for 30 days and are exclusive of Value Added Tax (unless stated otherwise) and carriage charges which shall be payable in addition to the price of the Goods. Prices are not guaranteed although every effort is made to maintain them.

Payment: Prices and Value Added Tax and carriage charges are strictly nett and payment is due at the time of order placement (unless stated otherwise) when the full invoice value becomes due. Payments can be made in Cash or online by Debit/Credit Card (VISA, MASTERCARD, JCB, EUROCARD, SWITCH & DELTA CARDS).

Delivery: The delivery time stated on this web site is an estimate only and shall not be considered a contractual obligation. The Company shall not be liable for any loss or damage sustained by the buyer due to the Company's inability to maintain the delivery times so stated. The Goods will be at the buyer’s risk when delivered to the buyer (please refer to note 1 'DELIVERY OF GOODS BY A THIRD-PARTY CARRIER'). The Company's obligation to deliver Goods is subject to circumstances beyond the Company's control as (but not limited to) strike, floods, fires, machine breakdown or any other conditions of force majeure.

Specifications: Technical data, dimensions, weights & colour etc., stated within the online catalogue on this web site are a guide only, and no guarantee is given or implied that Goods will conform in absolute detail to the descriptions and illustrations. The Company reserves the right to amend specifications and to withdraw Goods from its product portfolio without prior notice.

 

3. BESPOKE ITEMS / MADE TO MEASURE
We do not refund or returns on any items that are made to order / measure or personalised, this relates to but is not limited to UPVC and Composite Doors, Windows, Double Glazed Units Cut to Size Roofing materials. With exception of faulty or damaged goods. 

If you (the buyer) is unsure please contact info@clydewindows.com or 01698 331111 for further clarification before ordering. 

4. REFUNDS
We will refund  any undamaged and unused items, providing we have been notified in writing at info@clydewindows.com no more than 7 days from the date you have received your products, with exception of any bespoke / made to measure items. (Please refer to note 3 Above BESPOKE ITEMS / MADE TO MEASURE). Where this request is made there would be a 30% restocking fee plus a collection fee which will match your original shipping fee or £30 whichever is greater. 

5. FAULTY GOODS OR ITEMS
If you believe an item is incorrect or faulty you must make us aware as soon as possible in writing at info@clydewindows.com or 01698 331111, faulty goods will be inspected by the manufacturer if proven by the manufacturer that there is a fault with the product you will be entitled to send the product back for exchange or full refund on the faulty item in question. 

FAILURE TO OBSERVE THE CLAIMS PROCEDURE CAN INVALIDATE THE COMPANY'S CONTRACTUAL LIABILITY UNDER THESE CONDITIONS OF SALE.

This does not affect your statutory rights as a consumer.
